Under and by virtue of the power of sale contained in a certain Purchase Money Deed of Trust from ECI Holdings LLC, dated April 22, 2010, and recorded among the Land Records of Baltimore City, Maryland, in Liber 12658, folio 450, default having occurred under the terms thereof and at the request of the party secured thereby, the undersigned Substitute Trustee will sell at public auction to be held at 1010 W. Cross Street, Baltimore, MD 21230, the following: All that fee simple interest of ground situate and lying in Baltimore City, and knowns as Tax ID # 21-07-0856B-007 and being more fully described in the aforementioned Deed of Trust as 1010 W. Cross Street, Baltimore, MD 21230. The Property contains 1,592 square feet, more or less. The information contained herein was obtained from sources deemed to be reliable, but is offered for information purposes only. The Substitute Trustee does not make any representations or warranties with respect to the accuracy of this information. The Property and improvements thereon will be sold subject to all other conditions, restrictions, and agreements of record, or otherwise, affecting the same, if any. The Property and improvements thereon are being sold without warranty, express or implied, of any kind, in "as is" condition. TERMS OF SALE: A deposit by certified check or cashier's check of $5,000.00, will be required of the purchaser at time and place of sale. Deposit(s) to be increased to 10% of the purchase price within 24 hours at the offices of the Auctioneer. The defaulted purchaser shall not be entitled to any surplus proceeds resulting from any resale. Interest to be charged on the unpaid purchase money, at the default rate of 18% per annum from date of sale to date of settlement. Adjustment of current year's real property taxes are adjusted as of the date of the sale, and thereafter assumed by the purchaser. Taxes due for prior years including costs of any tax sale are payable by the purchaser. Purchaser is responsible for any recapture of the homestead tax credit. All other public and private charges or assessments to the extent such amounts that survive the foreclosure sale, including water/sewer charges, ground rent, whether incurred prior to or after the sale to be paid by the purchaser. The Property will be sold in "AS IS" condition, without express or implied warranty as to the nature and description of the improvements as contained herein; and subject to easements, agreements, restrictions or covenants of record affecting same, if any. Purchaser shall be responsible for obtaining physical possession of the Property.
